Car Accidents - Personal Injury Compensation Claims with clickandclaim's Personal Injury Solicitors
Car accidents — also called road traffic accidents (RTAs), traffic collisions, auto accidents, road accidents, personal injury collisions, motor vehicle accidents, and crashes — kill an estimated 1.2 million people worldwide each year, and injure about forty times this number. The term "accident" could be considered an inappropriate word as we would estimate that upwards of 90% are the result of driver negligence. The Department of Transport publish road deaths in each type of car. Some cars are safer than others and some will protect you better in an accident. There is no car, however, which can entirely protect you from the behaviour of other road users. If you are injured as a result of "driver negligence" other than your own then you may be able to make a claim for compensation.
Driver negligence can take many forms, set out below are just some of them.
-
Driving too fast;
-
Failing to keep any or a proper lookout;
-
Failing to brake, steer or otherwise control a vehicle so as to avoid the collision;
-
Failing to stop at a junction.
-
Failing to have any or adequate regard for traffic which was or might reasonably be expected to be at a junction.
-
Failing to heed the traffic conditions.
-
Failing to give way.
-
Driving into collision with the rear of the vehicle in front.
-
Failing to drive within braking distance.
-
Failing to turn around in his/her car seat to observe the road behind him/her.
-
Driving on the wrong side of the road.
-
Failing to conform to a red light signal
-
Overtaking when it is not safe to do so.
-
Failing to give any signal before starting to manoeuvre.
-
Driving with defective brakes.
-
Driving with defective tyres.
-
Failing to properly and regularly inspect or cause the vehicle to be inspected to ensure that it is in road worthy condition.
This list is by no means exhaustive but if the car accident was caused by the other driver doing any of these things, you probably have a claim. You or a member of your family may have been injured and if this was as a result of negligence then you can make a claim. A car can be more dangerous than a gun, simply because speeding cars are so much more prevalent than speeding bullets.
All drivers should be insured but it is still possible to claim even if the negligent driver had no insurance. There is even a scheme which you can use if the other driver drove off without leaving his details. If another driver’s negligence has caused you injury you are entitled to compensation.
