Overview
Exposure to asbestos/asbestos fibres can be potentially deadly.
It was not until 1989 that asbestos was banned but up to that point it was widely used in military environments, fire proofing, sound proofing, insulation and in the automotive industry.
Symptoms
Unfortunately you may not notice any symptoms of exposure to deadly carcinogenic fibres for many years. However, exposure may eventually lead to such diseases as lung cancer, asbestosis, mesothelioma or pleural thickening.
For advice as to whether you consider you may be suffering from respiratory or other problems arising out of exposure to asbestos you should consult your GP as soon as possible. If a diagnosis is made then it would be prudent to seek legal advice urgently since asbestos and similar claims may involve a variety of technical and evidential difficulties and it is always sensible to start to make appropriate enquiries as soon as possible.
Time Limits
The normal time limit within which legal action must be taken is three years from the date when you knew or could reasonably have been expected to know that you have suffered injury, loss or damage.
In most ordinary Personal Injury claims the calculation of the three year period is straight forward but when dealing with these types of claims it is very often difficult to assess when a person became aware of difficulties which may only be noticed many many years later.
Because of the above complications it is always wise to seek advice as soon as possible.
Time does not run while a person is not mentally capable nor against a child who would be able to commence proceedings at any time up to their 21st birthday.
Potential Complications
In their working lifetime many people change jobs from time to time and if a person has been subjected to asbestos fibres in more than one job, detailed enquiries may have to be made to establish whether, and if so which, employer may be responsible.
In the past it had sometimes been difficult to establish which employer might have been responsible for causing any disease experienced by an individual and a claim may have failed if a particular employer could not be legally blamed. Fortunately the law has changed in favour of individuals recently so that it is now not nearly so difficult to pursue a claim even if an individual may have been employed by more than one person or company where they were exposed to asbestos fibres.
As in any claim it is important to establish the facts as quickly as possible.
